Forensic Reports have been made for various cases in both Indian and western context.

Following are a few prominent, high Profile cases where Forensic Reports were made...

People vs OJ Simpsons

Simpsons history supported the argument which might have been levied by forensic psychologists that in addition to the circumstantial evidence connecting him to the murders and his respect behavioural pattern at the inception of the investigation, Simpson did have a behavioural history that suggests mental illness and the psychological makeup to commit the double homicide quite certainly, indications of his temperament, of his tendency toward violence, of the frightening side which he displayed within the confines of his marriage and often in front of others could be considered safe efficient cause for a more intensive psychological evaluation, particularly considering the strength of DNA evidence against Simpson.

These conditions justify the frequently nuanced use of forensic psychology as a way of understanding Simpson's capability to commit deeds which evidence suggests he had the motives, the means, the lacking alibi by the varying witness accounts, and the scientific data to make a case against him.

Aarushi Talwar Murder Case

On 12 October, the Allahabad High Court delivered its verdict in the case, acquitting the Talwars of murder charges. Leading forensic psychologist from Gujarat, Dr SL Vaya, who had examined the suspects in the Aarushi-Hemraj murder case, told The Quint that she had found Talwars to be “innocent”. She also confirmed that she had not been able to give a “conclusive, definitive” clean chit to the servants. Dr Vaya said, “I had personally examined Talwars as well as Rajkumar (the domestic help of the Talwar’s family friends, the Duranis). My findings had shown that the Talwars were not involved. They were innocent. However, I could not say that about Rajkumar. My opinion about him was not definitive. It was not clear to me if he was innocent or involved or lying. Once we submit the report, how the investigating agencies use it is their choice. The prosecution of a case is a different ball game altogether. There are many aspects. But it’s true I was not called for (submitting) evidence in court.”

Hathras Incident

In the Hathras incident of 2020 which involved the gang rape and tragic death of a Dalit woman from Hathras, Uttar Pradesh by four upper-caste men, the forensic report proved that no rape was committed. The sole basis for this assertion was that “no sperm” was found in the samples collected from the deceased. However, the forensic report was subject to questioning given that the definition of rape included offences beyond the presence of sperm in vaginal samples. Therefore, it was suggested that Forensic medical examination in sexual assault cases should include the examination of injuries on the entire body and not just the genital or anal region.

“Forensic report key to establish crime in drug cases, says high court”

A high court bench granted bail to an accused in a drugs case, observing that the forensic report in drug seizure form the foundation of the prosecution’s charges and if the same is not there, the entire case would fall flat.
